1. Introduction
Jmwsm Group Pty Ltd (ABN 92 702 126 350) (“Jmwsm Group”, “we”, “us” or “our”) provides diversified group services to residential and business clients across Perth, Western Australia. We are committed to managing personal information in an open and transparent way and to complying with the Privacy Act 1988 (Cth) (the “Privacy Act”) and the Australian Privacy Principles (APPs). This policy applies to this website, jmwsmgroup.site, and to our broader business operations.
2. The Australian Privacy Principles
The APPs set out the standards, rights and obligations that apply to how Australian organisations handle personal information. In managing personal information, we have regard to APP 1 (open and transparent management), APP 5 (notification of collection), APP 6 (use and disclosure), APP 7 (direct marketing), APP 8 (cross-border disclosure), APP 11 (security of personal information) and APPs 12 and 13 (access to and correction of personal information).
3. Personal information we collect
Depending on how you interact with us, we may collect and hold:
- your name and, where relevant, the name of your business or organisation;
- your email address and postal address;
- the content of your enquiries, quote requests and instructions;
- records of our communications and dealings with you;
- billing and invoicing details reasonably necessary to provide our services; and
- technical information such as your IP address, browser type and the pages you visit on our website.
We do not ordinarily collect sensitive information (such as health information or information about beliefs or affiliations). We will only collect sensitive information where it is reasonably necessary for our functions, you have consented, or the collection is otherwise permitted by law.
4. How we collect personal information
We collect personal information in the following ways:
- Directly from you — when you submit a form on our website, send us an email, request a quote, or engage our services;
- Indirectly — through website analytics, cookies and similar technologies; and
- From third parties — where you have authorised them to share information with us, or where collection is otherwise permitted by the Privacy Act.
Whenever we collect personal information about you from you, we will take reasonable steps to notify you of the matters required by APP 5, including the purposes of collection and how you may contact us.
5. Why we collect and use personal information
We collect, hold, use and disclose personal information so that we can:
- provide, improve and personalise our group services;
- respond to your enquiries and prepare quotes and proposals;
- manage our client relationships, administration, records and invoicing;
- communicate with you about your engagements and our business;
- conduct marketing activities where permitted under APP 7;
- analyse website usage so we can improve our content and functionality; and
- comply with our legal, regulatory and record-keeping obligations.
We will not use or disclose personal information for a secondary purpose unless an exception under APP 6 applies or you would reasonably expect us to, or you have consented.
6. Disclosure of personal information
We do not sell personal information. We may disclose personal information to:
- service providers who assist us to operate our business, such as website hosting, IT support, analytics and accounting providers, subject to confidentiality obligations;
- professional advisers, including our accountants, auditors and legal advisers;
- government bodies, regulators or law enforcement agencies where required or authorised by law; and
- any other person with your consent or where permitted under the Privacy Act.
7. Overseas disclosure
Some of our service providers may be located outside Australia, or may store or process data on cloud infrastructure located overseas. Where we disclose personal information to an overseas recipient, we will take reasonable steps, as required by APP 8, to ensure that the recipient handles that information in a manner consistent with the APPs, or that an exception under APP 8 applies.
8. Security and retention of personal information
We take the security of personal information seriously. We hold personal information on systems protected by reasonable safeguards, including access controls and secure storage, and we limit access to personnel and providers who need it to perform their functions. We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.
We retain personal information only for as long as is reasonably necessary for the purposes for which it was collected, or as required by Australian record-keeping laws. Once no longer required, we take reasonable steps to destroy the information or ensure it is de-identified.
9. Cookies, analytics and online tracking
Our website uses cookies and similar technologies to operate the site, remember your preferences, and understand how visitors use our pages. This helps us improve our content and user experience. Most browsers allow you to manage or block cookies through your browser settings; however, disabling cookies may affect the functionality of some parts of the website.
10. Direct marketing
Under APP 7, we may use personal information to send you communications about our services where we are permitted to do so. Every direct marketing communication we send includes a simple way to opt out. You may also opt out at any time by emailing ceo@jmwsmgroup.site, and we will action your request promptly and free of charge.
11. Access to and correction of your personal information
You may request access to the personal information we hold about you, and request corrections where you believe it is inaccurate, out of date, incomplete, irrelevant or misleading (APPs 12 and 13). We will respond to your request within a reasonable period. There are limited circumstances under the Privacy Act where we may refuse access or correction; if that occurs, we will explain our reasons and how you can complain about the decision.
12. Notifiable data breaches
We maintain practices to identify and respond to data breaches. If a data breach is likely to result in serious harm to any individual whose personal information we hold, we will comply with the Notifiable Data Breaches scheme under the Privacy Act, including assessing the breach and, where required, notifying affected individuals and the Office of the Australian Information Commissioner (OAIC) as soon as practicable.
13. Anonymity and pseudonymity
Where lawful and practicable, you have the option of dealing with us anonymously or using a pseudonym. However, we generally need your name and contact details in order to respond to enquiries, prepare quotes and provide our services.
